Article 50(1) of the Lisbon Treaty states that “Any Member State may decide to withdraw from the Union in accordance with its own constitutional requirements”. The European Union Referendum Act 2015 is not binding on parliament, which remains sovereign. The UK’s constitutional requirements therefore require the approval of parliament before Article 50 can be invoked. MPs have a duty to act in the best interests of Britain and they are not bound to follow the outcome of the referendum.
