When applying for legal aid, they take very little about outgoings into account, so it doesn’t reflect an individual’s disposable income. Daily living costs, bills, food, and providing for children should all be included before getting a final disposable income figure.
Victims of domestic abuse can meet the criteria for legal aid due domestic abuse, but then are declined due to their “disposable income”. Essentials such as council tax, electricity, gas, water and all the other necessities of living and providing for children are not included in the calculations, so the “disposable income” amount is not a true reflection for real-life circumstances at all. This must change to protect victims of domestic abuse and their children from any future harm.
