There is a presumption in law that article 6 of the European Convention on Human Rights is engaged in civil service disciplinary proceedings.

The right to a fair hearing for civil servants follows the decision of the European Court of Human Rights in the case of Eskelinen v Finland ECHR 2007 (overturning its landmark judgment in Pellegrin v France ECHR 1999).

The government should amend the Discipline section of the civil service human resource policies to afford the protection of the guarantees of article 6 in the disciplinary procedures.
