A review is required of Section 58 of the Highways Act 1980 ,with a view to the Local Authorities loosing this as a defence against motorist’s pothole claims. Motorists are being left to pick up the bill for damage to their vehicles due to poor highway maintenance and highway inspections by Local Authorities highway departments.
This need to be redressed as councils should be compelled to pay for damage to vehicles caused by poor road surfaces when evidence is submitted to support motorist’s claims.
