The Directive enables airlines to reject refugees, even those with a valid asylum claim, to avoid repatriation costs. Thousands are dying on overcrowded boats as a result, falling prey to traffickers. Claims should be heard by qualified immigration staff and not rejected based on airline profits.

The Commissioner for Human Rights stated that this law violates "international human rights and refugee laws, which prohibit states from returning someone to places where they risk torture or where their lives or freedom are seriously threatened"
