Rejected petition Police too do mandatory checks on phones if in any car accident (Both Parties)

recently I was in an accident where they were using there phone - however police didn't feel the need too check due too vialating personal human rights. personally I feel this could have helped my case and I'm sure there are plenty of others in my situation.
