By designating such rises as a fee, the Government has avoided proper parliamentary scrutiny, ensuring the increase is only debated in a Committee.
The requirement for Parliamentary Debate would stop this loophole being used as a precedent for future "stealth" increases of taxation and/or other "charges".
I believe that the use of this method on Probate Charges is a red herring on the basis that most people will see high Probate charges as only hitting the rich. The danger is that, if unchallenged, it may be used by Governments to raise other charges/taxes which could hit everyone.
