1) First Group put in a tender that was significantly flawed. Why should they be compensated for the fact that you compounded their incompetence by judging it to be good? You should not get compensated for your own incompetence.

2) Using the same tender documents, Virgin put in a tender that seems to be far less flawed; AND they knew the First Group tender was flawed. Your initial tender process was therefore NOT FAULTY.
