With more new build properties being built with boundaries shared with public rights of way, and with a rise in the popularity of decking the 2m limit no longer prevents an invasion of privacy.

A building in a garden can be up to 2.3m to the eaves and yet a fence is restricted to 2m, allowing decking in properties to encroach on the privacy of neighbours, as well as their own (from being visible to users of the public right of way)
