Courts should be automatically forced in law to include enforcement powers gifted to the Police and Social Services, meaning if they can establish there are no safeguarding risks through investigations they can enforce the terms of the court order without the families needing to access the court.
After 2008 warnings notices were issued on court orders, this is not enough. There is not enough protection for the parties where there is non compliance. Court wait times for enforcement’s are lengthy and children and families are at risk without having legal protection. More than ever families are choosing to gain child arrangement orders and legal access agreements therefore these families deserve the protection of the law where there are no safeguarding reasons to breech these orders.
