Misgendering, is when a name or pronoun is used about a person (often a transgender person) which does not correctly reflect their gender identity. This undermines the person's identity and can be considered transphobic in malicious contexts. This is therefore discrimination and harmful to trans-peoples' well-being as it creates a hostile environment for them. This can affect their mental health and it therefore should be made a hate crime. Whenever this is done it should be prosecuted.

The act of deliberating mis-gendering someone is already a hate crime, if a court determines that this act demonstrated hostility based on that person's transgender identity, or that it was motivated by hostility based on their transgender identity.
