Petition Commission a review of divorce cases where one party had no legal representation

The Government should appoint a commission, that is independent of the judiciary, the Ministry of Justice, and the legal profession, to review all divorce cases in England since the withdrawal of legal aid in 2012 in which one party was not legally represented.

This Commission should identify cases in which lack of representation meant that people were deprived of the right to a fair trial – for example where an unrepresented party was not informed of claims against him/her, the evidence for those claims, the applicable laws, or the required presence at and expected behaviour in hearings.

The Commission should be tasked with recommending to Government the rectification of any injustices identified, for example by the annulment of judge's decisions and payment of compensation.
