Currently if a driving test candidate challenges a decision made by a DVSA Examiner on a driving test, the decision can't be changed, even if the appeal is upheld. They will only allow a free retest, or a refund. We want this changed, so decisions can be changed if an appeal is upheld.
Call for reform of Road Traffic Act 1988, Section 133, so that where an appeal against a driving test decision is upheld, the decision can and will be changed.
The Right to Appeal is an integral part of the UK constitution. Free Tribunals that determine outcomes of appeals must have the power to change decisions. We believe the absence of these powers means there is no justice.
