When a vehicle moves over or takes avoiding action to allow access to an emergency vehicle on call (using blue lights and sirens) and in doing so contravenes a road traffic act such as entering a bus lane or crossing a red light the driver is prosecuted. In such circumstances this prosecution should be waived and the driver not be taken to court.
