We are concerned that the “balance of probability” standard allows dismissal even where investigations are incomplete or evidence is not fully disclosed. This can risk unfair outcomes and undermine trust in the system. We think stronger safeguards are needed to ensure investigations are thorough, transparent, and evidence-led before such serious decisions are made
