Legislation containing commands and instructions which get punished when not applied in practice without any reason, logical explanation or logical consequence prevailing are decided when the legislature (the Parliament) is voting for binary logic. This practice is already restricted from happening.
The punishable act is usually innocent or not guilty to perform based on individual judgement and its punishment is derived by instructing on behalf of another individual deciding the law. Examples are the indoor smoking ban, the tobacco purchase ban and previous COVID restrictions. In these cases the law is decided by the Government instead of the Parliament because the Parliament votes on binary logic. The Constitution of 1215 prohibits arbitrary punishment of the law and limits these examples
