We are concerned that there is currently not sufficient investigation of domestic abuse allegations made by foreign spouses before granting indefinite leave to remain (ILR).

British spouses can face severe mental distress and years of legal costs after allegations are made before evidence is properly tested. Meanwhile claimants may be granted ILR and receive public housing, Universal Credit, NHS support, education assistance, and legal aid by taxpayers.

We believe genuine victims must always be protected, but there must also be safeguards against unsupported or fraudulent allegations used for immigration, financial support or child custody advantage. Proven misuse should lead to refusal of settlement, repayment of public funds where possible, and lawful removal from the UK.
