Rejected petition: Implement a 'pause and resume' mechanism for CMS enforcement orders

Rejected on

Mandate that CMS enforcement orders be 'paused'—not terminated—when a parent changes jobs or moves to benefits. This prevents 'job-hopping' parents from evading payments by forcing the CMS to restart the entire enforcement process from scratch, ensuring more consistent support for children

The CMS currently terminates all enforcement, including DEOs,bank and asset seizures, when a parent moves to benefits. This forces the CMS to restart from scratch, creating a loophole for parents who 'job-hop' to evade payments. We call for a 'pause, not terminate' policy: enforcement must automatically pause upon benefit entry and resume when income is detected. For those with a history of avoidance, the standard declaration grace period must be removed to allow for immediate, automatic enforcement

Why was this petition rejected?

It’s not clear what the petition is asking the UK Government or Parliament to do.

We are not clear what action you are seeking as it is not the case that all enforcement action ceases completely when a paying parent leaves their job or starts claiming benefits. For example, a deduction from earnings order may be revived or arrears may be collected via deductions from benefits.

We only reject petitions that don’t meet the petition standards.
