We call on the Government to legislate to protect domestic abuse victims’ personal medical records in family court proceedings by ensuring they cannot be required to be disclosed to the other party by the court.
We believe the current system can allow family court proceedings to become a continuation of post-separation abuse. Requiring victims to disclose highly personal medical records directly to an alleged or proven abuser can cause further trauma, discourage victims from seeking medical or mental health support, and undermine confidence in the justice system. We believe stronger safeguards are needed to protect victims’ privacy while ensuring courts retain access to relevant evidence when necessary.
