Open petition: Review information rights of families when LPAs are in place

We call on the government to review current laws and rights of immediate family members (except where safeguarding concerns exist) to receive medical, financial and welfare updates when a person lacks mental capacity and has a lasting power of attorney (LPA) in use.

We want the government to review the law to ensure that close family members are automatically notified when a lasting power of attorney is registered and used for a family member who lacks mental capacity. We want to see a legal right to receive appropriate financial, medical and welfare updates on an information-only basis. We believe attorneys should not be able to block appropriate information from being shared unless there are domestic abuse or safeguarding concerns. Families should have a clear route to challenge withheld information.
