Open petition: When parents are separated, Child Benefit to be awarded to the non-HICBC parent

Created by Karisha Hardman
Closes on

Change the Child Benefit rules so that, where separated parents have competing/rival claims and one parent is liable to repay Child Benefit through the High Income Child Benefit Charge (HICBC), the award is given to the other parent who is not liable for HICBC.

Under current rules, where separated parents have equal care of a child, Child Benefit (CB) may be awarded to a parent who is liable to repay it through the High Income Child Benefit Charge (HICBC). The rules should require HMRC to consider whether the parent claiming CB is liable for HICBC. If they are, and the other parent is not, CB should be awarded to the parent who is not liable for HICBC. We believe this would ensure the benefit is retained for the benefit of the child and not repaid in tax.
