Open petition: Require misconduct investigations to properly conclude after resignation
Created by Georgia Spence
Closes on
Require employers to complete misconduct and gross misconduct investigations even if an employee resigns. Where allegations are substantiated, findings should be formally recorded. We believe employees should not be able to avoid accountability by resigning during an investigation.
Employees facing allegations of misconduct or gross misconduct can currently resign before disciplinary processes conclude, often leaving investigations unfinished and findings unrecorded. This can undermine confidence in workplace reporting procedures and leave those who raise concerns without closure. We feel resignation should end employment, not accountability and that employers should be required to conclude investigations and formally record substantiated findings.
