Open petition: Exempt homeowners from disclosing neighbour disputes when selling homes

Created by Melanie Workman
Closes on

Amend Consumer Protection regulations to exempt homeowners who are victims of criminal or persistent anti-social behaviour (ASB) from being legally required to disclose their neighbour’s behaviour & neighbour-related disputes when selling their home.

Homeowners should not be required to disclose this information on TA6 Property Information Forms.

Home sellers are currently required to declare neighbour disputes. We feel this unfairly punishes innocent victims of ASB, as it can trap homeowners facing noise, drug activity, or intimidation. This may force them to either stay in an unsafe area or slash their property price due to forced disclosure. Perpetrators face no financial penalty, while victims suffer financial loss. The government should create an "Innocent Seller" exemption. ASB should be treated as an external crime matter, not a defect of the property asset.
